GUEST OCCUPANCY AGREEMENT
THIS GUEST OCCUPANCY AGREEMENT (“Agreement”) is entered into upon acceptance of the booking at the online booking site, between St. Clair River Getaways, LLC (“Proprietor”) and the holder of the account at the online booking site (“Guest”).

NOTICE: PURSUANT TO THIS GUEST OCCUPANCY AGREEMENT, IT IS THE INTENTION OF PROPRIETOR AND GUEST TO CREATE A PROPRIETOR/LICENSEE RELATIONSHIP AND NOT A LANDLORD/TENANT RELATIONSHIP.
TERM: Guest is seeking from Proprietor the right to use as a vacation home the premises located at 8105 River Rd, Cottrellville, Michigan (“Property”), for a term commencing the check-in noted in the booking details after 4:00 p.m. and terminating on the end date noted in the booking details, check-out before 11:00 a.m.(“Term”). Check-out is made by the Guest completing all posted checkout steps and upon all persons vacating the Property.
HOLDOVER FEE: If Guest uses the Property after the Term has expired, Guest agrees to pay a holdover fee of $300.00 per day for each day the Property is used in excess of the Term. Guest agrees that this daily holdover charge shall be charged to Guest’s credit card.
GUEST FEE: For use of the Property as a vacation home, Guest shall pay Proprietor a fee as noted in the booking details for the Term. This fee shall not be reduced nor a portion of the fee refunded if Guest does not use the Property for the entire Term. Guest shall provide Proprietor with Guest’s credit card number should additional charges or damages be incurred during the use of the Property, including but not limited to charges for damages or other violations of this Agreement.
DEPOSIT: A deposit in the amount specified in the booking details is required at the time reservation is made. This deposit shall be used to secure the use of the Property for the Term and the performance of the Guest’s obligations under this Agreement.
DAMAGE AND SERVICE FEES: Guest agrees to provide a valid credit card in his/her name to be held on file in case the need to charge damage, excess cleaning, or service fees arises in accordance this this Agreement. If this occurs, guest agrees to the charge in the amount(s) specified. Such charges will be initiated within three business days of checkout, and an itemized list will sent via US mail and/or email to the listed address(es) within ten business days.
NUMBER OF OCCUPANTS: No more than 8 persons at any time, along with four cars in the party. PLEASE NOTE: The person(s) signing this Agreement must occupy the Property. No room(s) other than designated bedrooms are to be used as sleeping rooms or bedrooms unless otherwise noted. Proprietor has the option to terminate this Agreement or increase the Guest Fee at its discretion for the entire Term of occupancy if there is evidence indicating one (1) or more additional persons may be occupying the Property or using outside facilities, including, but not limited to: tents, cars or mobile homes, for sleeping.
SMOKING: Smoking is not allowed inside the Property. Failure to comply with this provision will result in Proprietor having the option to immediately terminate this Agreement, increase the Guest Fee and/or assess a service charge of $50.00 plus the costs of cleaning and repairs, which Guest agrees will be billed to Guest’s credit card.
PETS: Proprietor allows dogs, cats or small domestic animal on the Property on a case-by-case basis and under the following terms: Pre-approval must be obtained from Proprietor. A $50 pet fee will be levied. Guest assumes all liability and responsibility for actions of any pets, and they must be held in positive control at all times. Guests, occupants and visitors must pick up after the pet in all areas of the Property. If the Guest or visitor fails to comply with this provision, Guest agrees that a service charge of $50.00 plus the labor incurred in picking up after the pet, billed at the rate of $35.00 per hour, will be billed to the Guest’s credit card.
TELEPHONE: If any telephone charges appear for international, directory assistance, or collect telephone calls appear on the Property’s monthly telephone bill for the Guest’s period of occupancy, Guest agrees that a service charge of $20.00 will be billed to the Guest’s credit card, in addition to the cost of the calls.
DIRECT TV (“Pay per View”) CABLE TV (if provided): Guest is responsible for all “Pay per View” Cable charges incurred while occupying the Property. If any “Pay per View” charges appear on the Property’s monthly bill for the term of the Guest’s occupancy, Guest agrees that a service fee of $20.00 plus the cost of the “Pay per View” charge will be billed to the Guest’s credit card.
HOUSEKEEPING AND MAINTENANCE OF THE PROPERTY: Guest shall keep and maintain the Property in a clean and sanitary condition at all times and upon check-out, Guest shall return the Property to Proprietor in as good a condition as when received, ordinary wear and damage by the elements excepted. Failure to return the Property in a clean and sanitary condition may result in additional cleaning charges billed at $30.00 per hour, which Guest agrees will be billed to Guest’s credit card.
ORDINANCES AND STATUTES: Guest and all occupants and/or visitors shall comply with all statutes, ordinances and requirements of all municipal, state and federal authorities now in force, or which may hereafter be in force, pertaining to the use of the Property.
DAMAGES: Guest shall be responsible for any damages or alterations to the Property caused by Guest’s negligence and that of any occupant or visitor. Should any damages or alterations to the Property be noted upon inspection after Guest’s departure, Guest agrees to a service charge of $50.00 plus the actual cost of all repairs, which Guest agrees will be billed to Guest’s credit card.
REPAIRS: Upon discovering an item needing repair, please notify Proprietor during business hours or if an emergency, immediately. All repairs will be made as soon as possible. Proprietor shall not refund any part of the Guest Fee due to the failure of fixtures or appliances resulting in short-term inconveniences.
LIABILITY: Guest agrees not to use or allow the Property to be used in any way so as to create any nuisance and not to use or allow the Property to be used in such a way as to create claims, loss, expenses or damages to any person or property in or upon the Property. Guest agrees to indemnify, defend and hold Proprietor harmless from any and all claims and damages including actual attorneys’ fees and costs arising from the Guest’s, occupant’s or visitor’s use of the Property or from any activity, work or action, permitted or allowed by the Guest in or about the Property or area in which the Property is located unless caused by Proprietor.
DOCK AND RIVER: Guest agrees that use of the dock and river, if undertaken, will be at Guest's sole discretion and Guest assumes all risk and liability. Guest agrees to all aspects of "LIABILITY" section above as specifically applied to use of the dock and river. There is no lifeguard available. This waiver remains in force even if especially hazardous conditions manifest themselves, including but not limited to ice, cold water, river currents, submerged hazards, structural instability, or any other known/unknown risk.
RIGHT OF ACCESS: Proprietor reserves the right to enter the Property at all reasonable hours for the purpose of inspection, to make repairs as necessary and for the purpose of cleaning the Property.
DEFAULT: If Guest fails to perform any provision and/or term of this Agreement, Proprietor, at its sole option, may immediately terminate all rights of the Guest and the occupants. If the Guest abandons or vacates the Property having damaged the Property, in addition to all other legal remedies available to Proprietor, Proprietor may consider any personal property left on the Property to be abandoned and dispose of the same in any manner allowed by law. Guest shall be liable for the actions of all occupants, visitors or other persons on the Property during the Term.
ASSIGNMENT AND SUBLETTING: Guest shall not assign this Agreement or sublet any portion of the Property without prior written consent of Proprietor.
CANCELLATION: If Guest cancels the reservation at least 60 days prior to the beginning of the Term, 100% of the deposit shall be refunded. If Guest fails to cancel the reservation at least 60 days prior to the beginning of the Term, the deposit is non-refundable and will be billed to Guest’s credit card. All cancellations must be made in writing and delivered to Proprietor via personal delivery or first class mail.
ATTORNEY FEES: The prevailing party in an action for the enforcement of this Agreement and/or for breach of any of the provisions of this Agreement shall be entitled to payment of all costs and actual attorney fees by the non-prevailing party.
WAIVER: A one-time waiver of any provision or condition of this Agreement by Proprietor shall not be construed as a subsequent waiver of the same provision or condition. No breach of a provision or condition of this Agreement shall be deemed to have been waived by Proprietor unless such waiver is in writing and signed by Proprietor.
ENTIRE AGREEMENT: This Agreement sets forth all the promises, agreement, conditions and understandings between Guest and Proprietor concerning the Property and there are no agreements, conditions or understandings, either oral or written, between them that are not set forth in this Agreement. No alteration, amendment, change or addition to this Agreement shall be binding upon either party unless in writing and signed by each party.
SEVERABILITY: If any provision or portion of this Agreement shall be deemed invalid or unenforceable under applicable law, such event shall not render invalid or unenforceable the remainder of this Agreement.
QUIET ENJOYMENT: As long as the Guest performs all the covenants and conditions of this Agreement, he/she shall have peaceful and quiet enjoyment of the Property for the Term of this Agreement. The Right of Quiet Enjoyment also extends to neighbors of the Property; guest agrees to occupy the Property in a manner which preserves this
BINDING EFFECT: This Agreement shall be binding on the representatives, successors and assigns of the parties.
EFFECTIVE DATE OF AGREEMENT: This Agreement shall become effective only upon execution and delivery of the Agreement by Proprietor and Guest and by Guest paying the deposit to Proprietor.
CONTROLLING LAW: This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan. Venue for any legal action to enforce or interpret this Agreement shall be in St. Clair County, Michigan.
I HAVE READ THIS GUEST OCCUPANCY AGREEMENT AND AGREE TO ITS TERMS AS A CONDITION OF MY SHORT TERM USE OF THE PROPERTY AND AGREE TO BE RESPONSIBLE FOR ALL MONIES OWED AND AUTHORIZE ALL MONIES OWED TO BE CHARGED TO MY CREDIT CARD.

While this profile only lists me, it would be more apt to list us. The St. Clair River House has grown as a labor of love undertaken by my wife Susie and I. As the listing states, we began our time in this area living in the House, and have kept it in our family to share it with you all. We both have full-time "real" jobs and do this in our spare time, and endeavor to make your stay at our former home as special as the time we have spent there. We have two small boys who regularly "help" us with work on the house, and there's a good chance if you need any in-person hosting that you may meet one of them!
Our life here in southeast Michigan is inextricably connected to the water, and this shines through on the experience we strive to bring to you.
