Adjacent to the commons is one of the Capes most Beautiful Catholic Churches, Christ the King. Woods Whole is just a short 20 minute drive to hop a Ferry to the Islands. Many Golf courses are also close by.

The occupancy of the rental property shall commence at 3:00 p.m. (the “Check-In Time”) on the fifth (5th) day of May 2017 (Friday) and shall terminate at 10:00 a.m. (the “Check-Out Time”), on seventh (7th) day of May 2017 (Sunday) unless terminated at an earlier date in accordance with the provisions of this lease dealing with default.

**Time is of the essence: Please be aware that until we receive the signed contract and payment, we must continue to make the house available to others in the event that you decide not to proceed.
Confirmation of the reservation will be mailed, faxed, or emailed to Renter upon receipt of the initial reservation deposit. Upon receipt of final installment and security deposit directions and key location will be mailed. Checks or money orders should be made payable to Richard M. Palanza.
The security deposit will be returned by regular mail to Renter within 45 days following Renter’s vacating the Rental Property, minus the costs to clean, repair or replace any damage or loss to the Rental Property or the contents (including lost keys). If additional amounts are owed for damages sustained, said amounts shall be paid within 30 days of the owner providing evidence of damages to the property and the losses incurred.
Description of Rental Property:
The Rental Property consists of house located at_________, Mashpee, County of Barnstable, State of Massachusetts. The Rental Property is comprised of the following rooms: Living Room, Kitchen, Master Bedroom, two Bedrooms, and a Full Bathroom. The property has one King size bed, one twin over a full bed, and a double bed.
The Rental Property is furnished with washer & dryer, cable television, microwave oven, and all kitchen appliances, dishes & utensils, and phone (local calls only). Owner will attempt to provide a sufficient supply of trash bags.
The Renter will supply towels, and bed linens. The rental property will have household blankets and pillows. Renter supplied heaters are not allowed.
Notice to Owner of Repairs Needed:
If the Rental Property or any of the contents are damaged, not working or otherwise in need of repair or replacement, the Renter must promptly notify the Owner. The Owner will have a reasonable amount of time to make repairs. Renter understands and agrees that Owner may enter the Rental Property at any time for the purpose of making needed repairs. The owner can be reached in case of emergency at

In the event that the Renter cancels the reservation for any reason, a cancellation fee will be charged. If the cancellation occurs at least thirty (30) days prior to the Check-In Date and the Owner is unable to re-rent the Rental Property by the Renter’s Check-In Date, the Renter will be liable for fifty (50%) percent of the rental costs. If the cancellation occurs less than thirty (30) days of the Check-In Date, all monies paid by Renter will be forfeited if the Rental Property is not re-rented by the Check-In Date. Owner will make all reasonable efforts to re-rent the Rental Property by the Check-In Date.
TERMS AND CONDITIONS
It is understood and agreed between all parties that the Renters will accept the rental property as is, upon arrival, provided that it meets the basic standards of habitability under Massachusetts’ law.
It is understood and agreed between all parties that the Renter and permitted occupants of the Rental Property will abide by the following terms and conditions, and that any breach thereof will, at the Owner's option, give the Owner the right to declare this Rental Agreement null and void, and said term ended, and the Owner shall have the right to re-enter the Rental Property and remove or have removed all persons therefrom, and in such event, Renter agrees to forfeit all payments (including security deposit) made on account of this Rental Agreement and all remedies and rights they may possess hereunder:
Guests: No other persons shall occupy the Rental Property, except those registered in this Rental Agreement. Occupancy of the Rental Property is limited to 6 persons and 4 cars on the property during the day and night.
Smoking: There shall be no smoking in the Rental Property.
Pets: No pets (including birds) of any sort are allowed in the Rental (EMAIL HIDDEN)plaints: Any complaints to the Police Department concerning the behavior of the Renter while occupying the Rental Property shall result in immediate termination of this Rental Agreement., and if requested, renter shall vacate the rental property immediately.
Right of Access: Owner or the Owner’s agent shall have the right but not the obligation to enter into the Rental Property and upon the premises, at all reasonable hours, to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements thereto as Owner may deem appropriate, but the Owner agrees not to exercise this right in such a way as to unreasonably interfere with the quiet enjoyment of the Renter.
Trash: Trash bins are located in the front yard. Trash pick-up is on Tuesday and Saturday. It is the Renter’s responsibility to ensure that all trash is placed in the bin provided and placed curbside by 6a.m.
Parking: Available at the property. The driveway can accommodate 4 cars.
Lock-Out Policy: In the event the Renter and/or other registered occupants are locked out of the premises, the Renter must contact the Owner or caretaker for a replacement key and renter shall be responsible for obtaining replacement keys from owner or caretaker.
Damage to Rental Property and Contents: The Renter and all registered occupants of the Rental Property shall be liable for all damages caused during their occupancy. Cost of repairs and/or replacement shall be deductible from the security deposit. If the amount of security deposit is insufficient to pay any damages, Renter agrees to pay all additional amounts incurred by the owner.
Indemnification: Renter agree to indemnify and save harmless the Owner from any liabilities, damages, costs or expenses whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Renter’s use and occupancy of the Rental Property including but not limited to any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by Renter. The term “Owner” as used in this Agreement shall include Owner’s heirs, successors in interest, assigns, employees, managers, and representatives where the context requires or permits. The terms “Renter,” “You,” and “Your” as used in this Agreement shall include Renter’s heirs, successors, assigns, guests, invitees, representatives and other persons on the Rental Property during Renter’s occupancy (without regard to whether such persons have authority under this Agreement to be upon the Rental Property), where the context requires or permits.
Licensee: It is agreed that the Renter is a mere licensee with the permission to occupy the premises under the terms set forth herein. In no event shall a tenancy be created or established by this Agreement.
All occupants of the Rental Property must be listed in this Rental Agreement and each occupant over the age of eighteen (18) years shall be equally responsible for observing the Terms and Conditions specified in this Rental Agreement. Each adult occupant will be jointly and severally financially responsible for damage done to the Rental Property beyond normal wear and tear. The Renter's signature certifies that Renter is over eighteen (18) years of age, has read this Agreement, and understands that breaches of any terms can and will result in loss of the security deposit plus any additional costs.
Renter’s Responsibilities at Check-Out Time:
At Check-Out Time, the Renter shall give over possession of the Rental Property to the Owner in the same condition of cleanliness, order and repair as it was when the Renter took possession at Check-In Time. Renter shall ensure that all of the following items are taken care of:
appliances and work surfaces in the kitchen must be clean;
dishes, pots and pans and utensils must be clean and put away;
floors (other than carpeted areas) must be swept, but not vacuumed;
any food in the refrigerator must be removed and disposed of, and the refrigerator left in a clean condition;
any spills in stove burners/grill must be cleaned up, and the range top, oven and microwave left in a clean condition;
the bathrooms must be clean and No sandy towels placed in the dryer;
personal linens and towels removed from premise, blankets folded and pillows placed on beds;
the furnishings and grounds shall also be left in the same state they were in at Check-In Time;
all trash must be bagged, taken out and placed in the trash bins provided;
all keys shall be left on kitchen counter. Renter must ensure that all doors and windows are properly secured and locked.
all occupants must vacate the Rental Property by the Check-Out Time. A late check-out fee of $100.00 per hour will be charged for all late check-outs.
In the event that the Renter fails to comply with this Section, the Owner may at his option, complete the work, clean or repair and deduct the cost from the security deposit held by the Owner. Nothing in this lease shall in any way prevent the Owner’s right to recover any sum due in excess of the security deposit.
Assignment, Subletting, Amendments:
The Renter may not assign this Rental Agreement or sublet the Rental Property under any circumstances.
It is understood and agreed between the parties that the Rental Property shall be used and occupied for leisure/vacation and for no other purpose without prior consent of the Owner. The Renter agrees that they will not use or permit any person to use the Rental Property for any purpose in violation of the laws of the United States, the State of Massachusetts, or of any other lawful authorities.
This document, including any attachments incorporated by reference herein, constitutes the entire and sole agreement between Owner and Renter.
In the event that it is necessary to retain an attorney to enforce the terms of this Lease, to provide services for the removal of all persons from the property, or should action be brought to regain possession of or repair loss or damage of the property, the owners shall be entitled to reasonable attorney’s fees, court costs plus damages. All legal proceedings must take place in Barnstable County, Massachusetts.
In signing this agreement, tenant acknowledges this is a five-page lease agreement that he/she has read, understands, and will abide by all the rules, and regulations contained on each page. This is a legally binding contract.
