The villa has three bedrooms, three bathrooms, an expansive patio with grill, private splash pool, six person golf cart, courtyard, two outdoor showers (one is private off the master bedroom) a jacuzzi tub.

Our local concierge has been working with us for over 10 years and has been in the hospitality business even longer. She is your best resource to enjoy a spectacular vacation experience. We are fortunate that she is also our Property Manager. This means that she is not just your go-to for everything from airport transfers & grocery pre-stocking, but can assist with your questions about appliances and TV controls.

We include a six person golf cart that can be used within the gates of Punta Mita. At this time, taking the cart outside the gates (into the village) is prohibited for all Punta Mita residents. Parking is available at the fitness center near the gate. From there it is a quick, yet leisurely stroll to the finest of restaurants, entertainment and recreation in the village.

SHORT-TERM LEASE AGREEMENT ENTERED INTO BY AND BETWEEN (“LANDLORD”) AND (“TENANT”), PURSUANT TO THE FOLLOWING REPRESENTATIONS AND WARRANTIES

REPRESENTATIONS

I. The Landlord represents and warrants that:
a) He is the owner of Las Palmas, Villa #1 (the “Subject Property”), located in Las Palmas Subdivision in the Punta Mita Development, in Bahía de Banderas, Nayarit, 63734, Mexico.
b) He desires to lease the Subject Property to the Tenant; and
c) Within the Punta Mita Development may be diverse construction work being completed of which the Landlord is not part of nor is he responsible for, therefore, the Landlord hereby waives any right or obligation derived or deriving from such construction work.

II. The Tenant represents and warrants through its legal representative that:

a) The tenant will provide an email address and cell phone number(s) so that the concierge and property manager can maintain pre-arrival, departure and on-site correspondence.

b) He desires to lease the Subject Property, as per this Agreement; and in view of the foregoing, the parties hereto grant the following

ARTICLES

ONE: OBJECT
The Landlord leases and the Tenant takes in lease the Subject Property referred to in Representation I above.

a) For the Term per the Airbnb agreement
Check-in time: 3:00 p.m. – 8:00 p.m. (or as otherwise arranged in advance)
Check-out time: 11:00 a.m. with the understanding that this Term may be extended by mutual agreement between the parties, subject to availability.

b) The parties hereto agree that there may be living in the Subject Property during the Term, a maximum of 8 (eight) people, and that the Subject Property is comprised of: 3 bedrooms, 3 bathrooms, a splash pool, an outside shower off the master bedroom, a private garage with access to a six person golf cart for use within the gated community only. At this time, Village regulations strictly prohibit taking carts outside the gates of Punta Mita. Should you like to visit the village, cart parking will be available near the gate so that you can proceed to the village on foot.

TWO: PRICE
The rate for this Lease shall per the Airbnb agreement. The parties hereto agree that Tenant’s Payment shall provide a refundable Security Deposit via Airbnb’s policies which shall serve to pay telephone calls as well as those defects that the Subject Property or its furnishings may suffer during the Term; the remaining balance, if any, shall be returned to the Tenant via Airbnb.

THREE. SERVICES.
The Tenant shall use and enjoy the following services: housekeeping every other day, water, propane, electricity, color TV’s in each room, Satellite TV, and one DVD player in the living-room. Tenant acknowledges that the Subject Property is in good standing and any repairs shall be made by the Landlord.

The Tenant shall only use the parking area designated for the Landlord.

The Landlord has a Premium Golf Membership, therefore, Tenants will have guest access to the following services within Punta Mita, per availability. Tenants are subject to pay full rates, plus taxes and any applicable service charges. Note: During holidays or peak season times, access to the resorts may be limited or excluded based on their occupancy and discretion.

* Residents' Beach Club: Access to adult pool, children's pool, restaurant and beach. Spa services and many recreational activities are also available. Reservations are not required, but are strongly recommended.

* Kupuri Beach Club: Access to pool, restaurant and beach. Spa services and water & fitness activities for adults and a Kids Club. Reservations are not required, but are strongly recommended.

* Four Seasons Resort: Access to restaurants, per availability, reservation required. Tennis courts, per availability, reservation required.

* St. Regis Resort: Access to restaurants & beach club, per availability. Access fees apply. 24 hour advance notice/reservation required.

* Punta Mita Tennis Center: Per availability, reservations required.

* Punta Mita Bahia and Pacifico Golf Courses: Per availability, reservations required.

* Punta Mita Fitness Center: Daily & weekly rates available.

In order to have access to the noted amenities, Tenant agrees to send photo ID’s to our concierge at least two weeks prior to arrival. This will allow time for guest access cards to be processed and ready upon check-in. Flight arrival and departure details must also be provided to our concierge to coordinate check-in and departure.

FOUR. NON-REIMBURSEMENT.
The cancellation policy is per the Airbnb agreement.

SECURITY DEPOSIT REIMBURSEMENT.
The tenant is responsible for a Security Deposit in the amount of $1,000.00 per the Airbnb stated terms. The Security Deposit will reimburse damages to the property itself, the furniture within it or the golf cart during the stay and/or any unpaid telephone calls that were not paid on the departure date.

FIVE. WAIVER OF LIABILITY.
The Tenant agrees to waive any claim of liability against the Landlord for injury, damages or theft that may occur during the occupancy of Tenant in the Subject Property.

Likewise, the Tenant understands that there is no smoking allowed and he shall not have pets or animals in the Subject Property.

SIX. EXECUTION.
The parties hereto establish that this Agreement contains those terms agreed upon by the parties and that any modification shall be in writing and signed by the parties.
