PLEASE NOTE: Linens, bath towels and beach towels are provided after Labor Day and before Memorial Day. During the summer months linens will need to be rented by a local service or you are welcome to bring your own.
The rental agreement below will be emailed to you for from HappiTravels for your review, signature and will need to be returned to complete the reservation:
Section 1: Check-in is after 4 PM and check-out is 10 AM. There may be an hourly fee for any persons or belongings left in the rental or garage past the 10 AM check-out time and for every hour there after.

There is a $50 per hour early check in fee if requested. Early check in may not be possible and is absolutely not available in the summer months, no exceptions.

There is a $50 per day/night charge for any visitors not listed on the rental agreement and/or exceeding 6 guests to be paid prior to arrival. Please let me know if there will be additional guests prior to arrival.

Section 1A:

Please be sure you make arrangements for bed sheets, pillow cases, blankets, bath towels, hand towels, wash cloths and beach towels. Memorial Day weekend through Labor Day weekend.

(Please be sure to put pillow cases on ALL pillows as there will be a deduction from the deposit for stained pillows and/or damaged pillows.

You will need sheets, blankets and 2 king plus 8 standard pillow cases for:

1) California king mattress with a pillow top (in the main bedroom)

2) One Full size bed (in the second bedroom) Queen size sheets are fine for this bed.

3) Twin bed (in second bedroom)

4) Twin size and single sleeper sofas (in the living room). Twin sheets will fit the single mattress

Due to the size of the living room only one of the sleeper sofas can be used during your stay.

Mattress covers, pillows without pillow cases, bedspreads for all beds

and two kitchen towels are provided.

SHEETS/BATH TOWELS/BEACH TOWELS ARE AVAILABLE TO RENT or you are welcome to bring your own. There is a coin operated full washer and dryer for your use.

Section 2:

Please be aware this is a 700 sq. ft. unit which sleeps 2-4 comfortably. Six people will be close quarters.

Section 3:

Flooring- Please be careful of the flooring it is very sensitive to liquid and scratches. Please carry, do not roll suitcases on floors or stairs.

Refrigerator/freezer: Please do not overfill the refrigerator or freezer. There are fans/vents inside the back of each that if blocked will stop air flow which could lead to repairs which you will be responsible for if it is determined the damage was due to over packing the refrigerator or freezer. The refrigerator and freezer are checked prior to check in and check out.

No outdoor equipment is allowed in the house! This includes bikes, surf boards, boogie boards, skate boards and ice chests! Any outdoor equipment found indoors can result in full forfeit of deposit.

Section 4:

Payment- Full payment of rental fee is required 60 days before arrival.

Monthly reservation cancellations- Monthly renters must cancel 120 days prior to check in. Monthly renters who make a change that results in a shortened stay must be made at least 90 days prior to check in.

Section 5: NOISE:
Please respect the neighbors and other guests. There may be a forfeit your deposit and/or eviction if the neighbors and/or other guests report noise disturbances between 10PM to 8 AM. This includes children, loud voices and music! If children/babies are "expressing themselves" please close windows.

Section 6:

DAMAGE/RESERVATION DEPOSIT- The reservation deposit automatically converts to a security/damage deposit upon arrival. The deposit is NOT applied toward the rent. The deposit is fully refundable within 14 days of departure, provided the following provisions are met:

No damage is done to the unit or its contents, beyond normal wear and tear.

No charges are incurred due to contraband or collection of rents or services rendered during the stay.

All keys and remotes are left on the kitchen counter and the unit is locked.

All charges accrued during the stay are paid prior to departure.

No linens, towels, dishes, cookware, boogie boards, chairs, fins or bikes are lost or stolen or damaged including make up on towels.

All towels and linens are not to be taken from the unit or stained.

Furniture: Please do not rearrange the furniture, beds, mattresses, place indoor furniture outdoors or take decorations off the walls! There has been an unusual number of guests moving couches between units, dismantling beds and removing wall decorations. This will result in full or partial deduction from the deposit for cleaning staff time to reorganize or for damage.

Umbrellas Strong winds can occur. Please close all patio umbrellas during strong winds to avoid damage to persons, property and/or cars parked on the street.

NO early check in or late check out.

No smoking in the rental or on the property.

No illegal drug use in the unit or on the property.

The renter is not evicted by the owner (or representative of the owner), or

the local law enforcement.

Evictions will result in full loss of deposit, rent, taxes and cleaning fees.


If there is damage beyond the deposit amount the guests agrees to pay the full amount of damages.
Fireworks: Fireworks are illegal in the city of Newport Beach

Initial walk through: When you arrive, please inspect the unit for cleanliness, broken or damaged items. You must report any such issues to the owners or housekeeping staff within two hours of check-in.

Natural disasters: No refunds will be given for natural disasters, we highly recommend you purchase travel insurance. If you wish to purchase travel insurance go to (URL HIDDEN)

Construction/Neighborhood noise: No refunds for local construction or neighborhood noise.

SMOKING!!

Smoking on the premises will result in full forfeit of deposit! (including vapor cigarettes).

This includes the house, both outside patios, garage and directly behind the building.

Smoking is only allowed on the grass area behind the building. Cigarette butts found in the alley can end up in dolphins mouths! Yes we are THAT close to the ocean!! There will be a deduction from your deposit if cigarette butts are found in alley. Please dispose of butts in the public trash cans near the grass.

Please exit to the rear of the building through the gate near the tree so as not to disturb the upstairs guests by opening and closing the garage door to smoke.


Section 7:

Coin operated washer and dryer is shared by both units. The washer and dryer are available for the lower unit to use between 3 PM-9 PM daily. Please be considerate to the lower guests and have all of your laundry removed from the washer and dryer after 9PM.

When the cleaning service is cleaning the other unit the washer and dryer will not be available to use from 10am-3pm. You will receive an email 24 hours prior to the cleaning service arriving. Please do not use the washer and dryer when the cleaning people are there.

Section 8:

FALSIFIED RESERVATION: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money and the party will not be permitted to check in.

Section 9:

No fire pits allowed on the premises.

No large pieces of indoor furniture allowed outdoors. No fireworks. Fire works are illegal in the city of Newport Beach.

Section 10:

There is no smoking on the premises (including vapor cigarettes). The premises includes the house, both outside patios, garage and behind the garages. Smoking in these areas can result in full forfeit of deposit! Smoking is only allowed on the grass area behind the building.

Please do not litter. Cigarette butts found in the alley can end up in dolphins mouths! Yes we are that close to the ocean!! Please dispose of butts in the public trash cans near the grass.

Section 11:

Excessive sand found in rental, tub or sinks can result in full forfeit of deposit!

Section 12:

No Pets- Pets reported on premises will result in loss of full deposit.

Please remind any visitors that pets are not allowed on the property at anytime. Pets on the property, including the patios, will result in forfeit of entire deposit!

Section 13:

Parties, Noise, Alcohol use, and liquidated damages

Parties often cause disturbances, and result in the police being called. You will find a policy below regarding damages if police are called.

Please note: Anyone under the age of 21 caught with alcohol WILL be cited/arrested. Alcohol is not allowed on public property and that includes the beach. The police have a no tolerance policy.

Because of prior disturbances, the following policy has been implemented.
Most police intervention is due to a breach of the peace. When and if the police determine it necessary to arrive at the premise occupied by Guest(s) to investigate any activity by the Guest(s) or occupants authorized, either directly or by implication by Guest(s), and that activity is founded and verified, and such activity violates the peace and/or other resident's, tenant's, and/or guest's peaceful and quiet enjoyment of their property,or violates other city or county ordinances or Local, State, and/or Federal penal codes, rules, regulations, or case law, and/or necessitate any intervention due to any action or failure to act by any Guest, activities causing damage to the owner,owner's reputation, and/or business reputation, and possible cumulative damages leading to the city negating the license will result in cash damages paid by Guest(s) of $1500 as liquidated damages and not as a penalty, and completely separate and distinct from the "deposit", and can result in automatic simultaneous immediate eviction to prevent further damages to the premises, business, owners reputation in the community, and business reputation. Both parties agree that $1500 in liquidated damages will compensate owner for actual time spent to investigate and evict, speaking with witnesses, neighbors, Guest(s) and Co-Guest(s), legal consultations and legal fees, associates time, and security personnel time. This $1,500 will cover only these costs up to 5 hours total and Owner(s) have the right to pursue actual damages which exceed the 5 hours anticipated. This liquidated damages clause is only by and between the Owner and Guest(s) and any other injured party may bring their own cause of action against the Guest(s), including, but not limited to the City of Newport Beach.

Upon such violation(s),

Guest(s) will immediately surrender the property back to Owner, and without further notice, other than warnings herein agreed to be locked out of the unit until such time as the liquidated damages can be paid to Owner. Only then will Guest(s) be allowed back into the unit to remove their personal belongings.


Section 13 A:
INFORMED CONSENT AND RELEASE OF LIABILITY
Guest: A guest is well defined in California Law. Guests, for the purposes of this agreement, are individuals who occupy the property for less than 30 days and have entered into a written agreement with the owner to occupy the property prior to occupancy. Guests may have less rights than tenants in California. Some minor children or others unable to enter into agreements on their own, who are legally related to the Guest(s), may be considered Guests as per this agreement, but only if they are listed in the agreement and the Guest(s) have informed and they have consented to the agreement to the best of their abilities. When a Guest unilaterally invites another person, without prior written authorization, knowledge, or consent of the Owner, to enter the property and premises, that person(s) are not Guests and are considered trespassers. All other individuals not listed on agreement who enter the property are also considered trespassers and have no right to be on the property and may be expelled at the demand of the Guest, owner, or agents of either, at will, and immediately, should they be discovered and have no explanation or legal claim for their presence. Oftentimes, Guest's children bring other minor friends. The parents of those friends must sign releases in order to meet the requirements of being a Guest.

Owner: The owner is defined as the person who has a secured interest in the property, who pays the taxes on the property, who is otherwise responsible for the property's upkeep, maintenance, and all other associated duties related to property ownership. .

Theft or loss of property, security cameras. Fully operational and functional video cameras are installed at the outside access points of the structure and in the garage and each is obvious and visible, for the safety and protection of guests, guest's personal property, and ownership interest. As a result of these cameras, and other factors, ZERO property losses have been reported under current ownership. However, should such occur, these recordings will be made available to you to help you pursue prosecution or insurance claims. For your privacy, there are no security cameras within the interior of the structure. Our goal is for you to have the most fun, most comfortable, and safest trip possible for you and your family. I acknowledge that I have been notified about the placement of security cameras, that I have informed each person in my party of the existence of these cameras, that I understand that video cameras will be recording video for our safety, protection, and comfort at each access point of the units.

Section 14:

BIKES- There are two older beach cruisers available which you are welcome to ride at your own risk. There are locks to all bikes and steel loops on the front patio next to the mail box to SECURELY lock them to. Although this is a safe area, bikes can disappear quickly. The bikes are your responsibility. Any injuries which occur to the tenants or guests of tenants on the bikes is not the responsibility of the owner.

A person under 18 years of age shall not operate a bicycle, or ride upon a bicycle as a passenger, upon a street, bike way, as defined in Section 890.4 of the Streets and Highways Code, or any other public bicycle path or trail unless that person is wearing a properly fitted and fastened bicycle helmet that meets the standards of the American National Standards Institute.

Also, riding bikes at night require that you have some kind of light on the bike or you MAY GET A TICKET! There are bike lights on the bikes. Please turn off the lights when not in use.

Section 15:

CANCELLATIONS- Cancellations that are made more than 60 days prior to the arrival date are subject to a 5% cancellation fee or $50, whichever is greater. Cancellations or changes that result in a shortened stay or that are made 60 days or less of arrival date, forfeit the full advance payment and reservation deposit. Cancellation or early departure does not warrant any refund of rent.

Section 16:

There is a tree house on the premises. No one is allowed on the tree or in the tree house at ANYTIME. Reports of renters disregarding this policy will result in forfeit of full deposit!!

The unit is privately owned, the owner is not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The homeowner is not responsible for the loss of personal belongings or valuables of the guest. There are stairs inside the unit, it is your responsibility to be sure all guests and children are safe. There is an alley behind the unit where cars can drive fast. Please be sure all guests are safe, especially small children. By accepting the reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

Section 17:

PARKING- There is ONE parking space available in the garage for EACH UNIT.

Garage size is 90"W X 192"L X 82"H.

Vehicles over the garage size dimensions will have to find parking on the street. Parking on the street in summer months can be difficult to find. Compact cars are easiest to park in garage. Cars larger than a compact may not fit in the garage! You are responsible for driving a vehicle that fits into the garage and you are able to park that vehicle in the garage.

DO NOT PARK BEHIND THE GARAGE AT ANYTIME! YOU WILL GET A TICKET OR BE TOWED! This includes loading and unloading of guests and supplies. Repeated offenses of parking behind the garage will result in deduction from deposit.

Parking behind the garage at ANYTIME may result of deduction of deposit!

If you park on the street watch for street sweeping signs where you park. You will get a ticket if parked on a street sweeping street after 8:30AM.

PLEASE DO NOT LEAVE YOUR CAR IN THE SHOPPING CENTER PARKING LOT WHERE JACK IN THE BOX IS AS YOU CAR WILL BE TOWED!!

Section 18:

Patio: The upper unit does not have an attached patio. Access to the front patio is via a breeze way along the side of house just outside the upper units door to the outside. The front patio is shared with lower unit, but each unit has their own separate patio table and BBQ on the front patio.

Section 19:

MAXIMUM OCCUPANCY:
There is a $50 per day/night charge for any visitors not listed on the rental agreement and/or exceeding 6 guests to be paid prior to arrival. Please let me know if there will be additional guests prior to arrival.

Any litigation shall be held in a Orange County court.


By signing below, I agree to all terms and conditions of this rental agreement. We are a family friendly property. Smoking is only allowed behind the building in the alley area behind the garage door in which your car is parked. Please do not litter.

Section 11:
Excessive sand found in rental, tub or sinks can result in full forfeit of deposit!
Section 12:
No Pets- Pets reported on premises will result in loss of full deposit.

Please remind any visitors that pets are not allowed on the property at anytime. Pets on the property, including the patios, will result in forfeit of entire deposit!
Section 13:
Parties, Noise, Alcohol use, and liquidated damages
Parties often cause disturbances, and result in the police being called. You will find a policy below regarding damages if police are called.
Please note: Anyone under the age of 21 caught with alcohol WILL be cited/arrested. Alcohol is not allowed on public property and that includes the beach. The police have a no tolerance policy.
Because of prior disturbances, the following policy has been implemented.
Most police intervention is due to a breach of the peace. When and if the police determine it necessary to arrive at the premise occupied by Guest(s) to investigate any activity by the Guest(s) or occupants authorized, either directly or by implication by Guest(s), and that activity is founded and verified, and such activity violates the peace and/or other resident's, tenant's, and/or guest's peaceful and quiet enjoyment of their property,or violates other city or county ordinances or Local, State, and/or Federal penal codes, rules, regulations, or case law, and/or necessitate any intervention due to any action or failure to act by any Guest, activities causing damage to the owner,owner's reputation, and/or business reputation, and possible cumulative damages leading to the city negating the license will result in cash damages paid by Guest(s) of $1500 as liquidated damages and not as a penalty, and completely separate and distinct from the "deposit", and can result in automatic simultaneous immediate eviction to prevent further damages to the premises, business, owners reputation in the community, and business reputation. Both parties agree that $1500 in liquidated damages will compensate owner for actual time spent to investigate and evict, speaking with witnesses, neighbors, Guest(s) and Co-Guest(s), legal consultations and legal fees, associates time, and security personnel time. This $1,500 will cover only these costs up to 5 hours total and Owner(s) have the right to pursue actual damages which exceed the 5 hours anticipated. This liquidated damages clause is only by and between the Owner and Guest(s) and any other injured party may bring their own cause of action against the Guest(s), including, but not limited to the City of Newport Beach.
Upon such violation(s),
Guest(s) will immediately surrender the property back to Owner, and without further notice, other than warnings herein agreed to be locked out of the unit until such time as the liquidated damages can be paid to Owner. Only then will Guest(s) be allowed back into the unit to remove their personal belongings.
Section 13 A:
INFORMED CONSENT AND RELEASE OF LIABILITY
Guest: A guest is well defined in California Law. Guests, for the purposes of this agreement, are individuals who occupy the property for less than 30 days and have entered into a written agreement with the owner to occupy the property prior to occupancy. Guests may have less rights than tenants in California. Some minor children or others unable to enter into agreements on their own, who are legally related to the Guest(s), may be considered Guests as per this agreement, but only if they are listed in the agreement and the Guest(s) have informed and they have consented to the agreement to the best of their abilities. When a Guest unilaterally invites another person, without prior written authorization, knowledge, or consent of the Owner, to enter the property and premises, that person(s) are not Guests and are considered trespassers. All other individuals not listed on agreement who enter the property are also considered trespassers and have no right to be on the property and may be expelled at the demand of the Guest, owner, or agents of either, at will, and immediately, should they be discovered and have no explanation or legal claim for their presence. Oftentimes, Guest's children bring other minor friends. The parents of those friends must sign releases in order to meet the requirements of being a Guest.
Owner: The owner is defined as the person who has a secured interest in the property, who pays the taxes on the property, who is otherwise responsible for the property's upkeep, maintenance, and all other associated duties related to property ownership. .
Theft or loss of property, security cameras. Fully operational and functional video cameras are installed at the outside access points of the structure, and each is obvious and visible, for the safety and protection of guests, guest's personal property, and ownership interest. As a result of these cameras, and other factors, ZERO property losses have been reported under current ownership. However, should such occur, these recordings will be made available to you to help you pursue prosecution or insurance claims. For your privacy, there are no security cameras within the interior of the structure. Our goal is for you to have the most fun, most comfortable, and safest trip possible for you and your family. I acknowledge that I have been notified about the placement of security cameras, that I have informed each person in my party of the existence of these cameras, that I understand that video cameras will be recording video for our safety, protection, and comfort at each access point of the units.
Section 14:
BIKES- There are two older beach cruisers available which you are welcome to ride at your own risk. There are locks to all bikes and steel loops on the front patio next to the mail box to SECURELY lock them to. Although this is a safe area, bikes can disappear quickly. The bikes are your responsibility. Any injuries which occur to the tenants or guests of tenants on the bikes is not the responsibility of the owner.
A person under 18 years of age shall not operate a bicycle, or ride upon a bicycle as a passenger, upon a street, bikeway, as defined in Section 890.4 of the Streets and Highways Code, or any other public bicycle path or trail unless that person is wearing a properly fitted and fastened bicycle helmet that meets the standards of the American National Standards Institute. I do have five various size helmets available. It is your responsibility to assure the proper helmet fit.
Also, riding bikes at night require that you have some kind of light on the bike or you MAY GET A TICKET! There are bike lights on the bikes. Please turn off the lights when not in use.
Section 15:
There is a tree house on the premises. No one is allowed on the tree or in the tree house at ANYTIME. Reports of renters disregarding this policy will result in forfeit of full deposit!!
The unit is privately owned, the owner is not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The homeowner is not responsible for the loss of personal belongings or valuables of the guest. There are stairs inside the unit, it is your responsibility to be sure all guests and children are safe. There is an alley behind the unit where cars can drive fast. Please be sure all guests are safe, especially small children. By accepting the reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
Section 16:
PARKING- There is ONE parking space available in the garage for EACH UNIT.
Garage size is 90"W X 192"L X 82"H.
Vehicles over the garage size dimensions will have to find parking on the street. Parking on the street in summer months can be difficult to find. Compact cars are easiest to park in garage. Cars larger than a compact may not fit in the garage! You are responsible for driving a vehicle that fits into the garage and you are able to park that vehicle in the garage.
DO NOT PARK BEHIND THE GARAGE AT ANYTIME! YOU WILL GET A TICKET OR BE TOWED! This includes loading and unloading of guests and supplies. Repeated offenses of parking behind the garage will result in deduction from deposit.
Parking behind the garage at ANYTIME may result of deduction of deposit!
If you park on the street watch for street sweeping signs where you park. You will get a ticket if parked on a street sweeping street after 8:30AM.
PLEASE DO NOT LEAVE YOUR CAR IN THE SHOPPING CENTER PARKING LOT WHERE JACK IN THE BOX IS AS YOU CAR WILL BE TOWED!!
Section 17:
Patio: The upper unit does not have an attached patio. Access to the front patio is via a breeze way along the side of house just outside the upper units door to the outside. The front patio is shared with lower unit, but each unit has their own separate patio table and BBQ on the front patio.
Section 18:
MAXIMUM OCCUPANCY: Do not exceed the maximum number of six occupants. There is a $50 charge per day for each additional overnight guest or daytime visitors beyond 6 guests total to be paid prior to arrival. Please let me know if there will be additional visitors prior to arrival.
Section 19:
Any litigation shall be held in a Orange County court.
By signing below, I agree to all terms and conditions of this rental agreement. I have read and reviewed Sections 1-19 of this rental agreement as well as read and reviewed either (URL HIDDEN) (SENSITIVE CONTENTS HIDDEN) Airbnb, (URL HIDDEN) or (SENSITIVE CONTENTS HIDDEN) web page for this unit and understand all details relating to the rental. I am over 25 years of age.

We had an amazing experience in this place! Rollo was so nice and helpful! He made sure we're all settled in and we got everything we needed. Place was so near in the beach, that anytime we can just go and not to worry if we need something from our place. All beach equipments are available which super super great! Highly recommend this place!

The home was great! Rolo met us when we arrived and told us everything we needed even though we were in a rush. Having easy access to the garage made it easier than I could have imagined. Also, you really do not need to worry about any supplies, my girlfriend and I were underprepaired but the garage had chairs, towels, toys for kids, and even an umbrella for fairer skinned people will appreciate. The beds were great and the A/C worked wonders. The bikes were fantastic, we just unlocked them and rode along the beach to breakfast with no issues . I would stay again in an instant. Eric and Julia

We had a great stay at Michelle's place and loved that it was a block from the beach. Take advantage of their bikes to cruz along the ocean and to check out the restaurants and shops that are close by!

Nice location but we were disappointed. Can't open windows, several confusing and unnecessary rules.

There are windows that open. The other windows have air conditioners for your enjoyment and comfort. The listing shows any rules which we suggest reading to be sure you are not uncomfortable with the standard rules prior to booking our properties. Not everyone is considerate with our properties so the rules are mainly common sense.
