Your Holiday Accommodation is provided in accordance with Kiama Council’s LEP Short Term Holiday Accommodation Control Plan which can be accessed at Chapter 12 of the following document(URL HIDDEN)

Please be aware that this property is monitored by Kiama Council Representatives, Kiama Residents and Neighbours of the property.

Failure to adhere to these Terms and Conditions may lead to extensive fines for the property owner and loss of their right to Holiday Let their property. Please ensure you read and understand the Terms and Conditions before proceeding.

DEFINITIONS

“Booking” means the period for which you have paid to stay at the Property.

“Property” means the premises you are staying in and its grounds, all its fixtures, fittings and equipment.

“Agent” means the owners and managers of the Property.

"Guests" means the persons who are registered to stay overnight in the Property during the Booking.

"Visitor" means a person a Guest permits to visit the Property during the Booking.

1. PARTIES & FUNCTIONS

Parties and functions are strictly prohibited. A breach of these conditions will result in immediate termination and eviction (no mater what time of day or night), without refund. Additional charges for security, cleaning, garbage removal, wear and tear, repairs etc will be deducted from your Bond. We do not accept bookings for Bucks Parties, Hens Nights, or Schoolies Groups.

2. VISITORS

Visitors are welcome to visit you at the property, however must depart quietly prior to 11.30pm on Friday and Saturday nights and 10pm on all other nights.

The number of visitors at the property must be maintained at a reasonable level to ensure neighbours are not impacted in terms of excessive noise and street parking.

As a guide the following is deemed to be reasonable levels.

3. PARKING

Off Street parking is provided at many of our properties which we encourage you to use. In line with the Kiama Council LEP please do not obstruct driveways or restrict residents parking.


4. NOISE

During your stay noise is be kept to a reasonable level, particularly after 10pm and before 9am. After 10pm noise that may be audible by neighbours is to cease.

5. PETS

Pets are not allowed at the Property under any circumstance, unless the property is specifically classified as Pet Friendly, and prior approval has been given.

6. SMOKING

Smoking is not permitted in the property under any circumstance. If you choose to smoke outside, cigarette butts are to be disposed of in bins provided.

7. LINEN AND TOWELS

As a minimum the following will be provided, Mattress Protectors on all beds, a Quilt in Cover and/or blanket/s for each bed, Pillows in Protectors, Bat Mat/s, and Tea Towel.

Where full linen and towels are provided, beds will be made. Bath towels, and hand towels will be provided.

Please ensure you check at the time of booking if Linen and Towels are provided.

8. CHECK-IN AND CHECK-OUT

Check-in time is not before 2pm on the arrival date unless prior arrangements have been made.

Check-out time is no later than 10am on your departure date unless prior arrangements have been made.

An early Check-In and late Check-Out may be available, however is subject to prior arrangements and availability. Extra charges may apply.

Keys are to be collected and returned to our office at 56 Terralong St Kiama, unless other instructions have been provided. Failure to return keys at the specified time may lead to additional charges.

9. ACCEPTANCE & RESPONSIBILITY.

Payment of the Deposit constitutes acceptance of these Terms and Conditions.


10. PAYMENT

A deposit of 50% of the total Tariff + the $30.00 booking fee must be received within 3 days of the Booking being taken by the Agent. Bookings are not confirmed unless and until this deposit is received.

Payment in full must be received no later than 7 days prior to your arrival.

Payment of the amount due must be received in Australian $ net of any bank or other transaction charges.

Please ensure payments are made within the specified time limits or the Booking may be cancelled automatically without notice or liability.

We accept payment by the following methods:

Credit Card - Visa or MasterCard. Please be aware a 1.5% Credit Card Surcharge will apply.

Credit Card – American Express. Please be aware a 3.5% Credit Card Surcharge will apply.

Bank Cheque or Money Order.

Personal cheques will be accepted if received at least 14 days prior to your arrival.

Cash payments are not accepted.

Direct Deposit to our Rental Trust Account. To ensure funds are received by the required date, please note that bank processing can take up to two days.

11. CANCELLATION OR VARIATION

If you wish to vary or cancel your Booking, please contact us immediately on (PHONE NUMBER HIDDEN).

Your deposit is non-refundable in the event of a cancellation. The property owner may agree to transfer monies to a new booking however any arrangements are at the owner’s discretion.

If you have paid more than the deposit or paid in full and cancel your booking the property owner may agree to transfer monies to a new booking, however any arrangements are at the owners’ discretion.

A variation of the Booking which reduces the number of nights stay will be a treated as a cancellation of the Booking in respect of those nights.

An administration charge of $20.00 will be charged for any variation or cancellation.

If the Agent is able to relet the Property for the period cancelled a part refund may be made less administration charges, commissions and expenses.

We have a minimum nights’ stay policy of 2 or 7 nights. No refund will be made for a variation to the extent that it breaches our minimum nights stay policy.

12. SECURITY BOND

A minimum Security Bond of $1000.00 applies on all properties and may be secured via the provision of:

Credit Card details, which is our preferred method, or Cash. The owner of the credit card must be in attendance at the property for the duration of the booking.

Details must be provided to the Agent upon confirmation of your Booking.

Any damage, loss or expense incurred by the Agent as a result of a breach of these Terms & Conditions will be charged against the credit card. Examples include but are not limited to any breakage, damage or excess cleaning requirements, extra Guests or Visitors beyond those declared.


13. UNAVAILABILITY

The booking is made in good faith by the Agent however may be subject to any change as notified by the owner prior to the commencement of the booking. If the Property becomes unavailable for your occupancy due to unforeseen circumstances (e.g. fire, storm, damage, etc) then the Agent will inform you immediately and endeavour to obtain suitable alternative accommodation for your occupancy; failing which any moneys paid will be refunded in full.

14. YOUR OTHER RESPONSIBILITIES

The Lessee must be 21 years of age or older.

You must comply with all applicable House Rules and all instructions from the Agent and the caretakers of the Property concerning occupancy, property, health, safety and quiet enjoyment of the Property and our neighbours.

You are responsible for damage, breakages, theft and loss at the Property and any part of it during your stay. You must notify us of this immediately. The Agent may recover from you repair or replacement cost (at the Agent's discretion).

Only the guests nominated and agreed in the Booking may stay in the Property over night. If any other guests stay extra charges will apply or the agreement may be terminated without refund.

Disturbance to our neighbours, including excessive noise, is prohibited and may result in termination and eviction without refund and extra charges may be made for security and other expenses.

Before departure, all food must be removed from fridges, all rubbish put in the appropriate council rubbish bins provided at the property, and crockery and cutlery washed and packed away. The Property must be left in a clean and tidy condition.

BBQ’s are to be cleaned after every use and prior to your departure.

Extra cleaning charges and tip fees may be incurred if the above items are not attended to. Should the cleaning fee be more than the usual cost for cleaning the property, you will be charged the additional costs over and above the normal cleaning fee which will be deducted from the security bond and charged to your credit card or deducted from any cash deposit.

All furniture and furnishings must be returned to the position they were in when you arrived.

The property should be vacated on time and secured. All windows and doors are to be locked and lights turned off. All keys must be returned to the Agent or as otherwise directed. You are responsible for the safekeeping and replacement of accommodation keys. Duplicate keys will be provided at an additional charge of $20.00

15. PROBLEMS OR COMPLAINTS

In the event of any problem or complaint, you must inform the Agent at the earliest opportunity so the Agent has the chance to rectify the situation as quickly and efficiently as possible. You must allow repair/service access to the property during reasonable hours.

Any complaint, which cannot be resolved locally, must be notified in writing to the Agent prior to departure from the Property.

Failure to follow this procedure this may hinder the ability of the Agent to rectify the problem or complaint and reduce or extinguish any claim you may have.

Any property description given by Ray White staff or promotional material is given in good faith and no responsibility for any misrepresentation of description detail can be accepted.

Isthmus is a very well appointed home, delightfully located right on the beach. We had a great stay and would recommend the property to anyone. Expect we will be back in the future.

Beautiful house right across from the beach, dog beach very close by. Lovely quiet location and wonderful to listen to the ocean from the front balcony. Lovely private pool, fully equipped pool table, home cinema with Netflix, huge spacious dog-friendly house with room for at least 2 families, air con, fabulous ensuite and walk in robe...need I say more? A fantastic stay. A little pricey but so nice to be away from the centre of town and traffic. Would happily stay there again and we have all quite fallen in love with Kiama Downs!

We really enjoyed our time at Isthmus. The pool was a hit, proximity to the beach was ideal. We all love the projector and Netflix on Saturday night. It was the perfect place for a milestone birthday celebration and we would love to come back some time in he future to enjoy the place again.

Had a wonderful time staying at ISTHMUS. It had great facilities with a wonderful view on the beachfront. Made good use of the bbq, pool & pool table. The host Susie was very friendly with great communication. Fabulous home with a convenient location. 10/10 for me !
