Short Term Rental Agreement:
2.Damage to Rental Property: In case the rental property does not return to its normal conditions, wear and tear from reasonable use excepted, based on the inspection report Owner shall supply Renter with an itemized list of charges, and Renter agrees to pay the cost of repair in full, not limited to the security deposit amount. The premise is inspected both before and at the end of each occupation. It is Renter’s responsibility to report all damage immediately (within 24hr) to local Property Management.
3.Accommodation and Lawful Purposes: Only Renter and persons listed on the Property Booking Form may use or occupy any part of the Premises. Subleasing, sharing or re-assigning is strictly prohibited. If any changes in occupants occur, Renter must have Owner’s permission. Renter agrees to use the premises exclusively for a private residence and in compliance with local municipal ordinances, board of fire underwriters’ rules and regulations, and for lawful purposes. Any Renter who violates any law or ordnance will immediately terminate occupancy without a refund.
4.Unauthorized Parties/Guests/On-site Events: parties/Unauthorized guests/Events are not allowed on the premises without prior written consent of the owners. Failure to comply with this rule will result in forfeiture of entire security deposit and immediate eviction from the property.
5.Nature of Use: Renter is hereby granted a license to use the Premises. Renter acknowledges and agrees that no form of tenancy has been created pursuant to Chaper 83, Florida Statutes through Guest’s use of the Premises.
6.Smoking: THIS IS A NON-SMOKING HOME. Smoking is not allowed inside the unit or in the garage/pool/patio area. There will be additional cleaning charge of $250 if Guest chooses to ignore this condition of booking.
7.Animals and Pets: Animals and pets are NOT permitted in the home. This condition is strictly enforced. If pets or animals are found to be occupying the Premises without authorization, a $500 cleaning fee will be charged.
8.Swimming Pool/Spa and Pool Heating: The owner and management do not accept responsibility in the event of injury or death caused as a result of the use of the pool. All children must be supervised at all times. Diving, horseplay or running around the pool area is prohibited. Caution must be taken around wet areas. Owner cannot guarantee the water temperature in either the swimming pool or spa. The actual water temperature will vary with the ambient temperature, time of use and prevailing weather conditions. In the unlikely event of any pool heating equipment failure, Renter shall report to Property manager. Owner and Management will do everything in its power to rectify any problems as quickly as possible. No compensation will be given for a malfunctioning heater or concerning complaints regarding pool and or spa temperatures.
9.Cancellation: Cancellation by Renter must be done in writing and is subject to the below strict cancellation policy. We strongly advise all guests to purchase Trip Insurance or CSA Travel Protection.
Strict: 50% refund up until 1 week prior to arrival, except fees.
Cleaning fees are always refunded if the guest did not check in.
The Airbnb service fee is non-refundable.
50% of the accommodation fees (the total nightly rate you're charged) are refundable if cancellation is done beyond 7 days of check-in date.
No accommodation fees will be refunded if cancellation is done within 7 days of check-in date.
A reservation is officially cancelled when the guest clicks the cancellation button on the cancellation confirmation page, which they can find in Dashboard > Your Trips > Change or Cancel.
Applicable taxes will be retained and remitted.
10.Failure of System, Appliance or Amenity: In the event the Premises sustains a failure of utility, system, amenity or appliance – including but not limited to water, sewer, electrical, mechanical or structure systems: Pool/spa heating, air conditioning, electronic or entertainment equipment or services: Cable TV, Internet, phone or any appliance – Owner and management shall not be liable to Guest in any loss or damages and no refunds will be given for such failures. Upon being notified of any malfunction, Owner and management will make a reasonable effort to promptly repair or replace the failed system or advertised equipment. No refunds for early departures.
11.Furnishing and Linens: Furnishings of the premises are subject to change without notice. Furniture, bedding, utensils or any other property supplied with the Premises must not be taken out or transferred from one property or another. Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged to the Guest. Moving of furnishing inside, outside, or in the game room of the Premises is strictly forbidden.
12.Insects and bugs: Since the climate Florida offers a tropical climate and everything that comes with it! It is on the same latitude as Bangladesh and Burma and thus insects or bugs feel they have the same right to any property as you! They may appear without warning, especially if any opened food is left around, so you need to bear this in mind for full enjoyment of your holiday. All properties are treated regularly for pest control but insects or bugs etc may still appear. Their favorite time is April through November during the wettest and most humid season in Florida. As home owner as well as local management company, we are not liable for any personal injuries from insects or bugs sustained by the renter, members of renter's family, servants, or visitors regardless how such injuries may occur.
13.Safety and Security: Due to State Fire Regulations under no circumstances may more than the maximum number of persons identified on the Booking Form occupy in the property. Children must be supervised at ALL TIME whilst in the pool area. Glass is NOT permitted in the pool area. The owners, or our management company reserve the right to enter the premises at any time for whatever reason.
14.Acts of God/Uncontrollable Changes: Owner reserves the right in any circumstances to cancel the booking and in this event we will return all sums (but without interest or compensation). In the event of a major change to the booking being necessary, owner will inform Renter as soon as reasonably possible, and if the Renter does not wish to accept the booking on this basis, we will cancel the booking and return all sums (but without interest or compensation)
15.Website information: All descriptions given on the website are made in good faith, but no liability can be accepted for error or omissions.
16.Force Majeure: We accept no responsibility for, and shall not be liable in respect of loss or changes caused by Force Majeure, e.g. strikes, Fire, Flood, Closure of Airports, Weather Conditions, War, Riots, Terrorist Activity, or any other event beyond our control.
OWNER SHALLNOT BE LIABLE TO RENTER, RENTER’S GUESTS, LICENSEES OR INVITEES OR ANY OTHER PERSON FOR ANY INJURY, LOSS OR DAMAGE TO ANY PERON OR PROPERTY, INCLUDING THEFT, ON OR ABOUT THE PREMISES. RENTER SHALL HOLD OWNER AND MANAGERS HARMLESS AND INDEMNIFIED FROM AND AGAINST ALL LOSS, INJURY OR DAMAGE OCCASIONED BY THE USE OR MISUSE OR ABUSE OF ANY PART OF THE PREMISES INCLUDING THE SWIMMING POOL AND SPA. KEEP CHILDREN AWAY FROM SPA AND POOL UNLESS THERE IS CONSTANT ADULT SUPERVISION. CERTAIN HEALTH RISKS ASSOCIATED WITH SPA USE. USE AT YOUR OWN RISK. RENTER AGREES NOT TO HOLD OWNER’S LIABLE OR RESPONSIBLE FOR ANY INDURIES, ACCIDENTS OR ANY OTHER DAMAGES AS RESULT OF POOL USE AND FROM OR AGAINST ANY OMISSION, NEGLECT, OR DEFUALT OF RENTER, RENTER’S GUESTS, LICENSEES ORINVITEES.
