This Vacation Rental Agreement (“Agreement") is made and effective on Paid Booking Date (“Agreement Date") by and between Tamara Thompson (“Owner") and (“Renter(s)"). The Renter attests that he/she is of legal age to enter into a contract in the State of Hawaii. This Agreement creates joint and several liability in the case of multiple Renters.
Owner hereby rents to Renter and Renter accepts in its present condition the condominium unit at following address: 57-101 Kuilima Drive Unit #133 Kahuku, HI 96731 in the Kuilima Estates at Turtle Bay (“Condo").
The property shall be in the same condition upon departure as at Check-in. Normal wear and tear accepted. If the premises appear dirty or damaged upon Check-in, Renter shall inform Homeowner or Maintenance Company immediately. Renter may cook only in the area specifically designated for that purpose. Renter must notify Homeowner or its Agents immediately in case of fire or other damage done to the property. Homeowner or its agents may enter the unit at reasonable times to make repairs or service requests.
People other than those in the Rental Party listed below may not stay overnight in the property. Any other person in the property is the sole responsibility of “Renter". All of the units are privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss or theft of personal belongings or valuables of the “Renter". By accepting this reservation, it is agreed that all renters are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
The term of this Agreement shall start on Paid in Advance Booked Arrival Date (“Arrival Date"), no earlier than 3:00PM, and end on Paid in Advance Booked Departure Date (“Departure Date") at 11:00AM, unless approved by the Owner.
Renter agrees to pay, without demand, to Owner as rent for the Condo, the sum of stated rental amount per booking site (website hidden), AirBnB, other booking agent and calendar the (“Rental Amount"), a non-refundable fee, cleaning of $150.00 for up to 5 people and stays less than 10 days, or for 6 or more people and stays of over 10 days the cleaning fee is $200.00. Hawaii taxes, including General Excise, County and Transient Taxes are 13.99%, AirBNB Refundable Deposit (See #4) required in the event of minor damages, excessive sand, extra laundry over 4 loads upon checkout or overuse of electricity over free 15KWH per day (see 4D). Reserved parking for one space is free with no extra resort fee.
Rental Amount must be received in the form of a credit card payment processed via the booking agent, funds via , or by personal check. One half of the total is due upon booking the reservation. The remaining half is due 30 days before arrival. Signed contract may also be returned via email, or scanned and emailed to (email hidden). (Effective dates on notices are described under “Notices" below)
A.The Condo shall not be reserved until said rental amounts are received and cleared by Owner's bank.
4. REFUNDABLE DEPOSIT.
Upon execution of this Agreement, Renter pays a refundable deposit of $500.00 TO AIRBnB, it shall be returned up to14 days after departure as long as there is no damage, electricity overage, excessive sand or extra laundry reported by the Housekeeper. Guest confirms adherence to Rental Rules to assure that no charges for damages etc. are made due to:
A.Damage to the property or furnishings
PROPERTY & FURNISHINGS: Our Property and its entire contents have been cataloged. A complete photo-inventory of the property and each and every item in it will be taken after every Guest's stay. If the property and/or any item are found damaged or missing, Guest is financially responsible for its value. Claims for damages etc. will be mitigated between Owner, Guest and Insurance Company. If the value of damages exceeds the insurance coverage, then Guest will be responsible for the monetary difference.
B.Dirt or other mess requiring excessive cleaning
EXCESSIVE SAND / CLEANUP: There will be a $200 additional charge for excessive sand and cleanup of excess trash removal. There are outdoor showers at the beach, and a hose downstairs. We ask that you shake out your beach towels before entering the condo, as sand can clog the plumbing system. Outdoor trash cans are conveniently located along the driveway.
HOUSEKEEPING: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. Should you like daily maid service please arrange with the owner prior to arrival. We provide beach towels for up to 6 people located in cabinet near lanai. We do not permit other towels or linens to be taken from the unit.
LAUNDRY: We allow for up to 4 loads of laundry per week if cleaned by Housekeeper after departure. There will be a charge of $10 per load in excess of 4 per week, which will be an after departure charge via credit card, check, or deposit deduction if applicable.
APPLIANCES: Only use appliances for their intended uses.
C. Any other cost incurred by Homeowner due to Guest's stay.
D. AIR CONDITIONER: Power cost is about twice as much in Hawaii as in the mainland. Therefore we ask that you do not run A/C when not in the condo unit; you'll find that the A/C cools down the property almost immediately. We allow a free consumption of electricity at a maximum of 15KWhs/day (about $5.25 per day-which is usually plenty) anything over that, the tenant will pay the overage calculated at the Hawaiian Electric rate of .35per KWH. Please be considerate; any Hawaiian Electric Company charges out of the ordinary during the rental time frame over the complimentary allotment used by the tenant, will be an additional charge via credit card, , check or deducted from the Deposit if applicable. The housekeeper photos the meter before and after each guest for your record if needed. When you return to the Condo, turn on the A/C it will take only a short time to get the bedroom to the coolness you are comfortable with. Use of ceiling fans and cross breezes from the lanai and front door screen are often very comfortable.
E.MISPLACED PARKING PASS / ENTRY KEY
1.PARKING DEVICE – If Parking Device is misplaced, there will be a $100 Replacement Fee.
2.ENTRY KEY –There will be a $50 Replacement Fee for misplaced Entry Key. (not applicable for autokey)
3.POOL KEY - There will be a $50 Replacement Fee for misplaced Pool Key.
(URL HIDDEN) PERSONAL SAFETY.
Renter acknowledges that Owner does not provide a security alarm system or any other security for the Condo or for Renter. Renter hereby releases Owner from any loss, suit, claim, charge, damage or injury resulting from lack of security or failure of security in any way. Renter should use caution when using the condo pools or stairways leading to and inside of the condo. Be sure to lock the front door when leaving the condo.
6.USE OF PREMISES / CONDO POLICIES.
Renter shall comply with the following Condo Policies according to the Home Owners Association:
No smoking in the condo or on the lanai, no loud music or pets allowed on premises.
c.Condo shall be locked upon leaving premises (even if on the Turtle Bay premises). Shoes shall be removed and left outside of condo or in foyer upon entering condo. No excess sand in Condo. No wet towels or clothing on furniture. Hang wet items on extra back bar over tub.
g. All garbage must be disposed of in bins on the parking lot.
Vehicles are to be parked in designated parking area only for unit #133 West. Parking on the road is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.
a.PARKING PASSES – Parking Passes are located inside the unit or can be picked up at the Resident Manager's building.
b.VEHICLES – Parking is limited to 2 vehicles.
8.NUMBER OF OCCUPANTS.
Renter agrees that the Condo shall be occupied by no more than 6 persons, including no more than 2 children under the age of eighteen (18) years, without the prior written consent of Owner through reservation acceptance.
9.CONDITION OF PREMISES.
Renter agrees that Renter has examined the Condo, and that it is, at the time of his/her arrival, in good order, operable, safe, clean and rentable condition. The Renter shall immediately report on day of arrival any exceptions or changes to this condition to the Owner at cell phone number: (phone number hidden).
ASSIGNMENT / SUBLETTING.
A.Renter shall not assign this Agreement, or sublet or grant any concession or license to use the Condo or any part of the Condo without Owner's prior written consent.
B.Any assignment, subletting, concession, or license without the prior written consent of Owner, or an assignment or subletting by operation of law, shall be void and, at Owner's option, terminate this Agreement.
11.ALTERATIONS AND IMPROVEMENTS.
Renter shall make no alterations to the Condo or make other improvements without the prior written consent of Owner.
12.RIGHT OF INSPECTION.
Owner and Owner's agents shall have the right to all reasonable times during the term of this Agreement and to enter the Condo for the purpose of inspecting the premises and/or making any repairs to the premises or other item as required under this Agreement.
13. HOLDOVER BY RENTER.
Should Renter remain in possession of the Condo with the consent of Owner after the expiration of the Term of this Agreement, an additional rental period shall be created which shall be subject to all the terms and conditions of this Agreement. If Renter holds over without Owner's consent, Owner is entitled to triple rent, pro-rated per each day of the holdover, lasting until Renter leaves the Condo.
14.SURRENDER OF PREMISES
At the expiration of the Agreement, Renter shall quit and surrender the Condo in as good a condition as it was at the commencement of this Agreement, reasonable cleaning excepted.
A.If there is a severe storm or hurricane, no refunds will be given unless:
1.The state or local authorities order mandatory evacuations in a “Tropical Storm/Hurricane Warning Area" and/or
2.A “mandatory evacuation order has been given for the area of residence of a vacationing Renter.
B.The day that the authorities order a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund:
1.Any unused portion of rent from a guest currently registered;
2.Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, to come in after the Hurricane Warning is lifted; and
3.Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period.
C.We do not refund due to road conditions.
(URL HIDDEN) FORFEITURE OF RENTAL AMOUNT
Cancellations must be in writing and received by the Owner, a minimum of 30 days prior to arrival date. Cancellations received within 30 days from date of arrival result in 100% forfeit of the Total Rental Amount. If the cancellation is received greater than 30 days but less than 90 days from the date of arrival, fifty percent (50%) of Total Rental Amount if forfeited. If cancellation is received greater than 90 days from the date of arrival, the larger of 15% of the Total Rental Amount or $200.00 is forfeited.
If any part or parts of this Agreement shall be held unenforceable for any reason, the remainder of this Agreement shall continue in full force and effect.
Renter acknowledges that Owner will not provide insurance coverage for Renter's property, nor shall Owner be responsible for any loss of Renter's property, whether by theft, fire, acts of God, or otherwise. We encourage all entries to purchase travelers insurance. *AAA recommends travel and rental insurance.
(URL HIDDEN) ARBITRATION
This agreement is governed by the laws of the state of Hawaii.
The covenants and conditions contained in the Agreement shall apply to and bind the Renter and permitted assigns of the parties.
This Agreement shall constitute the entire agreement between the parties. Any prior understanding or representation of any kind preceding the date of this Agreement is hereby superseded. This Agreement may be modified only in writing signed by both Owner and Renter.
Any notice required or otherwise given pursuant to this Agreement shall be in writing. The date of any notices sent via mail shall be the U.S. post-mark date. The date of any notices sent via e-mail, shall be the date received by the Owner.
IN WITNESS WHEREOF, the parties have caused this Agreement to be executed the day and year first above written.
